Terms and Conditions
Effective October 21, 2026
These terms are an agreement between you and 1591660 Ontario Corp. ("we", "us") for your use of Brain Otter at brainotter.com (the "Service"). By creating an account or using the Service, you agree to them. If you use the Service for a business, you confirm you are allowed to accept these terms for it.
1. What the Service does
Brain Otter helps a business with its marketing. It researches the business and its competitors, suggests topics, writes articles and social posts with AI, and publishes them to the website and social accounts the business connects (such as Pinterest, Facebook, Instagram and Google). It can also send email and text messages to contacts the business adds.
2. Your account
- You must be at least 18 years old.
- Keep your login details private. You are responsible for what happens under your account.
- Give us accurate information and keep it up to date.
3. Connected accounts
When you connect a third-party account (for example Pinterest), you authorize us to act on that account only as you direct: reading the information needed to show it in the Service and publishing the content you create or schedule. You can disconnect at any time in Settings or from the third party's own settings. Your use of those platforms is also governed by their own terms, such as Pinterest's Terms of Service.
4. Your content
- You own the content you add or publish through the Service, including content the AI writes for you.
- You give us a limited licence to store, process and publish that content only to run the Service for you.
- You are responsible for reviewing what is published under your name. The Service flags statements that may not match your business's facts, but the final decision is yours.
- AI-written content can contain mistakes. Check it before you rely on it.
5. Acceptable use
You agree not to use the Service to:
- publish anything illegal, misleading, hateful, harassing or that infringes someone else's rights;
- send spam, or email or text people who have not agreed to hear from you;
- break the rules of any connected platform, including Pinterest's Community Guidelines;
- attempt to access other users' data, overload the Service or reverse-engineer it.
We may suspend an account that breaks these rules.
6. Fees
If you use paid features, the prices and the monthly spending limit are shown in the Service before any charge. Fees already paid are not refundable unless the law requires it.
7. Availability and changes
We work to keep the Service running, but it is provided "as is" and "as available", without warranties of any kind. We may change, pause or stop features. Third-party platforms may change or withdraw their access, which can affect what the Service can do.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
9. Ending your use
You can stop using the Service and delete your account at any time. We may end your access if you break these terms. When an account is deleted, we delete its data as described in our Privacy Policy.
10. Changes to these terms
We may update these terms. If a change is significant, we will tell you by email or in the Service before it takes effect. Continuing to use the Service means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be handled by the courts of Ontario.
